Context

In common words cosmetics are products for beauty and care, an issue that already concerned the Egyptians 5000 B.C. Directive 76/768/EEC on cosmetic products defines a cosmetic product as: “any substance or preparation intended for placing in contact with the various external parts of the human body [...] with a view exclusively or principally to cleaning them, perfuming them or protecting them in order to keep them in good condition, change their appearance or correct body odors”.

Legal background

The Directive 76/768/EEC regulates the use of different substances. Cosmetics must not be harmful to human health when they are applied in normal or  reasonable conditions of use, and the consumer is protected against deception. A number of substances are banned and elements of labelling (e.g. INCI-declaration of the ingredients) are regulated. Further it imposes the duty of notification and reporting on the manufacturers and engages them to hold certain documents (e.g. assessment of the safety of  a product) ready for authorities. Consequently an effective quality control of cosmetic products becomes essential for commercial success and in order to prevent claims and public condemnation.
